Steps to Take after a First DUI Arrest
It is a good idea to speak to a DUI attorney as early in the process as possible. For example, in Pierce County, the arraignment date can be as early as one business day after the arrest.
Unfortunately, your Washington State driver’s license will be automatically suspended, unless you (or your DUI lawyer) request a hearing with the WA State Department of Licensing within 7 days of your arrest.
Your license suspension case with DOL and your criminal case are separate, however a good DUI lawyer should fight both cases.
WA DUI Penalties
If this is your 1st DUI, a conviction will result in the following penalties:
- Mandatory minimum jail time of 1-2 days or 15-30 days of electronic home monitoring
- Up to $5000 in court-imposed fines
- License suspension between 90 days and 2 years
- Ignition interlock device requirement
- Alcohol or drug treatment ordered by the court
How to Beat a First DUI in WA
Most people who are arrested for DUI have little or no criminal history. This can be very helpful during negotiations, even if the facts are not in your favor.

For example, your breath test result may be inflated, due to the common condition of acid reflux. It is also well documented that field sobriety tests can be very difficult to pass, even when completely sober.

Additionally, there are many protocols that law enforcement is required to closely follow during a DUI stop and any questionable behavior by the officer can be used to weaken the case against you.
